Welcome to LiveSwap. These Terms of Service (“Terms”) form a binding agreement between you and LiveSwap (“LiveSwap”, “we”, “us”, or “our”) and govern your access to and use of the LiveSwap website, applications, APIs, and related services (together, the “Service”). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
LiveSwap provides a real-time AI face swap engine that processes video from your webcam or other input source and outputs a transformed video stream. The Service is intended for lawful creative, entertainment, streaming, communication, and privacy use cases.
2. Eligibility & accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
3. Acceptable use
You agree not to use the Service to:
- Impersonate another real, identifiable person without their clear, informed consent, or in a way intended to deceive, defraud, harass, defame, or harm them.
- Create, distribute, or broadcast non-consensual intimate imagery, sexual content depicting minors, or any content that sexualises real people without their explicit consent.
- Commit or facilitate fraud, identity theft, election interference, financial scams, or KYC/biometric verification bypass.
- Generate content that violates applicable law, incites violence, promotes hatred against protected groups, or infringes third-party rights.
- Reverse engineer, scrape, resell, or attempt to extract the underlying models, weights, or source code of the Service.
- Circumvent rate limits, quotas, safety filters, or security controls.
We may suspend or terminate accounts that violate these rules and, where required, report illegal activity to the relevant authorities.
4. Your content
“Your Content” means any images, video, audio, prompts, or other materials you upload or stream through the Service, including your own face data and any reference faces you provide.
- You retain all ownership of Your Content. You grant LiveSwap a limited, worldwide, royalty-free license to host, process, transmit, and transform Your Content solely to provide and operate the Service for you.
- You represent and warrant that you have all rights, licenses, and consents necessary to upload Your Content and to use it with the Service — including the right to use the likeness of any person depicted.
- We do not use Your Content to train general-purpose AI models. See our Privacy Policy for details on data handling.
5. Output
Subject to these Terms, you own the output generated from Your Content (“Output”). You are solely responsible for how you use, publish, or distribute Output. Given the nature of generative AI, Output may be similar or identical across users; we do not guarantee uniqueness or non-infringement.
When you publish Output, we recommend disclosing that it was generated or modified with AI where doing so is appropriate or legally required.
6. Plans, credits & billing
- LiveSwap is a paid subscription service. Plans, pricing, and included minutes are described on our pricing page and may be updated from time to time.
- One credit equals one minute of live face swap time, metered to the second while you are actively streaming.
- Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period.
- Except where required by law, fees are non-refundable and unused credits do not carry over between billing periods.
- You authorize us and our payment processor to charge your chosen payment method for all fees and applicable taxes.
7. Intellectual property
The Service, including our software, models, designs, logos, and documentation, is owned by LiveSwap and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No rights are granted by implication.
8. Third-party services
The Service may interoperate with third-party tools (such as streaming software or virtual webcam drivers). Your use of those tools is governed by their own terms, and we are not responsible for them.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access — with or without notice — if we reasonably believe you have breached these Terms, created risk for LiveSwap or other users, or where required by law. Sections intended by their nature to survive termination (including ownership, warranty disclaimers, limitation of liability, and dispute resolution) will survive.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. Latency, quality, and availability depend on factors outside our control, including your network and hardware.
11. Limitation of liability
To the maximum extent permitted by law, LiveSwap and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising from or related to the Service will not exceed the greater of (a) the amount you paid to LiveSwap in the 12 months preceding the event giving rise to the claim, or (b) USD 100.
12. Indemnification
You agree to defend, indemnify, and hold harmless LiveSwap from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use or misuse of the Service, or (c) your violation of these Terms or any applicable law.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms and revising the “Last updated” date, or by emailing you). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which LiveSwap is incorporated, without regard to conflict-of-laws rules. You and LiveSwap agree to resolve any dispute in the competent courts of that jurisdiction, except where applicable law grants you a non-waivable right to bring a claim elsewhere.
